Customer Care - Policies Customer must be at least 18 years of age to utilize the Internet Network (as that term is defined in the Service Agreement), unless supervised by an adult. Customer may not misrepresent his/her identity or impersonate another person on the Internet Network. Customer agrees to use the Internet Network in a manner that conforms with all applicable laws and regulations. Customer specifically agrees not to make any attempt to gain unauthorized access to any other systems or networks contained either within or outside of the Internet Network. Customer understands that the Internet and other various networking communication mediums are not secure, unless explicitly specified as such, and may be subject to interception or loss. Customer further understands that the information available through the Internet Network or other interconnecting networks may not be complete, accurate, or virus-free. No warranties of any kind are made, either expressed, implied, or statutory concerning the data or information available through the Internet Network. Customer may not use the Internet Network to send unsolicited advertising, solicitations, promotional materials or like materials. Customer will not use vulgar, abusive, hateful or insightful language, whether explicitly stated, implied, or suggested through the use of symbols. Customer will also not use the Internet Network to harass others or intercept data transmitted by others over the Internet Network. Customer expressly agrees not to transmit (send or receive) obscene or pornographic materials over the Internet Network. This includes material which may be considered "indecent" or "appealing to the prurient interest", also commonly referred to as "adult" material. Customer agrees that CyberLynk shall have no liability for the services, data or information made available through the Internet Network, including any liability for any consequential, indirect, special or incidental damages regardless of the success or effectiveness of other remedies. Customer understands and agrees that the service provider will make every effort to keep the Internet Network of servers running continuously. However, our servers will, from time to time, be disconnected due to routine maintenance, upgrades and other required events. CyberLynk shall not be responsible for lost materials or information. Customer acknowledges that any product, process, or technology made available over the Internet Network may be the subject of intellectual property rights reserved by a service provider or others, and may not be licensed under this agreement. All content, development work, and domain names remain the property of the owner of such property. Customer expressly agrees not to delete, or alter in any way any legal notices or proprietary designations or notices in a file or that you upload to a Bulletin Board Service. Customer is responsible for telephone charges and other access charges that may be accessed for connection to the Internet Network. Customer is also responsible for any charges resulting from unauthorized access to your account until you notify your service provider of such unauthorized activity. Customer is solely responsible for maintaining the confidentiality of your password. For security purposes. It may be advisable to change your password often. CyberLynk shall not be liable for any direct, indirect, incidental or consequential damages, including, but not limited to, loss of business, lost profits, lost data, failure of security, whether or not such damages are foreseeable. CyberLynk reserves the right to remove any material which, in its sole opinion, may result in a violation of intellectual property rights of others or any other applicable Federal, State, Common, International laws or regulations, or pursuant to a court order. Customer understands that CyberLynk reserves the right to terminate the account at any time for failure to abide by the terms of this agreement or by failure to pay any fees or charges when due. Customer also understands that Customer may occasionally experience a busy signal. There are a number of reasons for receiving a busy signal including a telecommunications outage. Customers are asked to wait a few minutes and, then, redial the access number.
Customer understands that dial-up service is available under the following conditions: service is limited to active usage; usage will be terminated if inactivity exceeds twenty (20) minutes; and usage is limited to 4 hours per session. Usage shall not exceed ten (10) hours each calendar day or in the aggregate ten (10) hours per calendar day averaged over any calendar month. Accounts with a total monthly connect time of more than 300 hours, or 600 hours for 2B ISDN, may be considered a dedicated connection and CyberLynk reserves the right to suspend service on these accounts, or require the Customer to execute a dedicated connection agreement at the appropriate dedicated connection monthly rate.
